A tough fight for fees

The decision of the Insurance Supervision Commission (CSA for short in Romanian) to limit the brokerage fees in the case of vehicle insurance has brought about a tough fight, and the regulator lost a first clash last month.

Power Insurance, an insurance broker, contested the regulation change to the Court of Appeals in the city of Constanta which ruled to suspend the CSA decision. The ruling is not final, as it can be appealed to a higher court.

On another front, the National Union of Road Hauliers from Romania (UNTRR for short in Romanian) asked CSA to stop regulating the market without consulting the ones affected. UNTRR considers that transporters are badly affected by the policies’ prices increase - partly determined by CSA’s decision to limit brokerage fees - since insurance companies offer nothing more in exchange of the higher charges. The CSA replied that the third-party liability vehicle insurance is a policy for costs are not directly linked with the quality of services. Despite such evasive answers from the CSA, the fight is still on.
