AMICABLE FINDING, A SCARECROW FOR INSURERS

Form-finding amicable accident, defined in accordance with European directives issued by the Insurance Supervisory Commission, is pending approval by the European Insurance and Reinsurance Federation - CEA.

In theory, once endorsed by the European forum, the form called “finding amicable accident” will be used. Consequently, the visits to the police to declare light casualties will be avoided. The form will specify the circumstances in which the accident occurred, the identification data of the persons and vehicles involved, together with those of the insurers. The verbal statement of the finding made by the Police will remain as an option for reporting accidents. The ones involved in such accidents may opt for it or for the amicable finding. Although it leads to shorter proceedings to recover damages in the case of road accidents which resulted in only damage to property, using the form for finding amicable is not desired by insurers, for fear of increasing the number of fraud and default in auto insurance segment. Insurance companies deemed that are not ready for widespread use of the amicable finding, since they need to put money in training the personnel, as the damage inspectors should also have legal knowledge.
