Hungary finally came the European way in road transport regulations

The memorandum sent by the Transport Employers’ Association of Europe 2002 and the Romanian Transport Operators Federation (APTE 2002 and FORT, in Romanian) in June, to ask for Brussels’ intervention regarding the Hungarian trespasses did not start off a full investigation, but it quickened legislation’s alteration. The changes were also meant to adapt the Hungarian transport rules to the European legislation.

The appendices of the regulation discriminate the severity of the infringements and the related different value fine, from 40 to 3.000 euros.

On the other hand, the peremptory answer sent by the European Commission to the Romanian employers’ organizations, did not admit the veracity of the Romanian transporters’ accusations, but the communitarian representatives do not sharply exclude a deeper investigation, should stronger proofs be brought.

”Concerning their discriminatory character, it does not appear that Hungary applies different fines for drivers or undertakings from different Member States; therefore there is no incompatibility with Article 19 (1) of Regulation (EC) 561/2006. (…) The figures you present in your memorandum on the quantum of fines applied to Romanian transport undertakings do not by themselves demonstrate that the activities by Hungarian control authorities are carried out in a discriminatory way“, was part of the European answer to the weak evidence the APTE 2002 and FORT presented.
